SAINT LOUIS, MO (KMOX) - A legal battle over the one-percent St. Louis City earnings tax, and whether the city can collect it from people who worked at home in the county during the pandemic, has shifted to a new side battle in small claims court.
Attorney Bevis Schock is represneting an AT&T worker who already won once in small claims court, and now has to let the city have a do-over. Schock argues there's nothing in the law allowing the city to reach into the county and collect the tax from people who worked at home, "work performed or services rendered in the city, means that the city can impose the 1% earnings tax if you're in the city when you do your work or perform your services."
The City Collector of Revenue argues the earnings tax also applies to non-city residents who worked from home for an employer "whose office is in the city."
This new case could affect the outcome of a larger lawsuit over the earnings tax that Schock has been battling over for a year and a half. The small claims case is set for July 20th.
